Are Fireworks Legal In Sterling Heights?
Recently, Sterling Heights passed a new ordinance governing the use of “consumer grade” fireworks within the city. With the State of Michigan legalizing fireworks as of January 1, 2012, the city wanted to take maximum advantage of what it perceived as a rather limited ability to control fireworks. The state law forbids the local municipalities from banning the use of fireworks outright on the day before, day of, and day after ten officially recognized holidays. Since the cities cannot ban them outright for at least 30 days per year but are free to control the locations from which they can be used and their method of ignition, Sterling Heights has taken the concept to its ultimate realization.
The result is a case of a city government clearly overreaching and circumventing the intent of the state law. Take a look at the video in which I apply the city’s new restrictions to my own neighborhood. There is but one inescapable conclusion: fireworks are illegal in Sterling Heights.
